Terms and conditions of trade are things that I regularly see and advise upon. I also draft terms for specific businesses and make amendments to your existing terms. In the context of trade, Ts and Cs are the formal rules and conditions governing a business relationship, contract, or transaction.

Every business should have basic terms and conditions of trade which apply to all relationships with your customers. These determine the conditions under which you provide your goods or services.

They may include such things as:

  • Limitations of liability in the event of breach of contract by either of you
  • Terms of payment
  • Your customers’ obligations to you
  • Your obligations to your customer
  • Your customers’ right to cancel
  • Retention of title clauses in the case of the sale of goods
  • Your insurance arrangements
  • The period in which the goods must be supplied or the services delivered

These are generally provided to your customer before he agrees to enter into a contract with you.
